These Terms and Conditions ("Terms") govern your use of Whisprly ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Whisprly provides anonymous, end-to-end encrypted messaging and calling services. Users can create or join temporary chat rooms using unique room codes to communicate anonymously. All communications are encrypted and ephemeral — they are deleted when the session ends.
You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement.

Violations may be reported by users and can result in permanent restrictions. We cooperate with law enforcement authorities when required by law.
The App assigns random anonymous names and identifiers. You understand that:
The App uses AES-256 end-to-end encryption for messages and media. While we implement strong security measures, no method of electronic transmission is 100% secure. We cannot guarantee absolute security of your communications.
You are solely and entirely responsible for the content you send through the App. Since messages are end-to-end encrypted, the developer cannot monitor, review, moderate, or access the content of your communications.
YOU ACKNOWLEDGE AND AGREE THAT:
All messages, media, and room data are designed to be temporary. When a session is ended by the room creator, all associated data is permanently deleted. We do not provide data recovery services for deleted sessions.
The App supports peer-to-peer audio and video calls via WebRTC technology. By using this feature, you consent to direct network connections with other participants. Call quality depends on your network conditions and is not guaranteed.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE DEVELOPER MAKES NO WARRANTY THAT:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, ARISING FROM OR RELATED TO:
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED AND EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless the developer, and any affiliated parties from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) arising from or related to:
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts in India.
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.
We reserve the right to terminate or restrict access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
